(1) Article 2.5 : The disposals of the titles II, V, VI et VII are not applicable as far as a substance is used : b) into foodstuffs or food for animals (animal food) according to the regulation (CE) no 178/2002, including when they are used :
i) As additives in foodstuffs as an application of the directive 89/107/CEE of the Council dated on December 21th 1988 relative to the merger of the legisltations of Member states concerning the additives which can be used into foodstuffs intended for the human food (8)
ii) As flavoring substances into the foodstuffs as an application of the directive 88/388/CEE of the Council dated on Tune 22th 1988 relative to the merger of the legisltations of Member states on the subject of the flavors intended to be used in the foodsuffs and the materials for their manufacturing (1); and of the decision 1999/217/CE of the Commission date on February 23th 1999 which passed a repertoire of the flavoring substances used into or on the foodstuffs, established in application of the regulation (CE) no 2232/96 of the Euopean Parliament and the Council (2)
iii) As additives in animal food, as an application of the regulation (CE) no 1831/2003 of the European Parliament and the Council dated on September 22th 2003 concerning the additives intended fot the animal food (3);
iv) In animal food, as an application of the directive 82/471/CEE of the Council dated on June 30th 1982 concerning some products used in animal food (4).
(2) Article 2.5 : the disposals of the titles II, V, VI et VII are not applicable as far as a substance is used : a) into medicines for human and veterinary consommatio as an application of the regulation (CE) n° 726/2004 , of the directive 2001/82/CE of the European Parlaiment and the Council dated on November 6th 2001 establishing a community code concerning the veterinary medicines (5) and the directive 2001/83/CE of the European Parlaiment and the Council dated on November 6th 2001 establishinga community code concerning the medicines for human usage (6).
